Team-Anna :Parliament is not supreme, We the people is

Team-Anna needs to-talk safe-to the-pt--to-keep engagement going#NAC members led by Aruna Roy and Harsh Mander presented an alternative to Team Anna's and the government draft. NAC team said arresting Anna was the wrong move by the government they also added that Team Anna's draft of the Lokpal will give overarching powers to one body.Roy said the National Campaign for People's Right to Information (NCPRI), with which she is associated, has prepared a version of Lokpal Bill and would present it before the Parliamentary Standing Committee on Law and Justice and Personnel. "We must assert our rights. But to get rid of these institutions would be a great disaster for all the people in
this country. Therefore we must make it work," she said. "Our argument is that democracy is people's right in our system. So we must make these democratic institutions work for us and they must work for us," she said. #On Aug 20, 10:34 am, Nachiketa Tiwari <nachiket...@hotmail.com> wrote:
Kejriwal has gone on record to state that parliament is not supreme, but the public is. Ditto for Hegde. And ditto for Bhushan (younger). On the other side, the govt. is arguing that the parliament is supreme. Either of these arguments may sound "cool" but are very, very dangerous. All these entities, the govt., Kejriwal, ... know that in reality it is the Law, i.e. the Constitution, which is supreme. We are a society where Rule of Law, prevails above everything else. So, even if the parliament enacts something against the grain of Indian Constitution, it can be declared null and void by the Supreme Court. And the people express their voice thru the same Law. This is not a matter of academic debate. But too many a society have been held to fascists when they got beholden to "we the people are supreme". The French Revolution, where many individuals masquerading as leaders of **people** managed to kill tens of thousands of folks they did not like. Ditto for China and Russia. Nepal is a much more recent story. The Maoists also perpetrate anarchy by pretending to be voices of people. As Anna's movement gathers momentum, we have to be clear that it does not generate into a Nepal like situation, where a few individuals, who have zero rapport with people, manage to get themselves officially declared as the voice of people, and make all sorts of stupid and dangerous decision. The medicine in such a case could be very well worse than the cure

Lokpal Bill draft with standing committee.

A Parliamentary committee has sought public opinion and suggestions on the Lokpal Bill, giving people 15 days to send their feedback on the measure which proposes to create an anti-corruption watchdog. The Parliamentary Standing Committee on Law and Justice and Personnel on Saturday issued an advertisement in dailies giving out salient features of the Bill and asking people to send their opinions and suggestions within 15 days. While 15 days is the standard time given by parliamentary panels to people or organisations to send feedback on bills, it was an indication that the Committee will not be able to give its recommendations before the end of the Monsoon Session on 8September.th August as the deadline for Parliament to pass the bill.Soon after the bill was introduced in Lok Sabha on 4 August, the Rajya Sabha Chairman has referred it to the Committee and given it three months to give recommendations.
The Standing Committee on Law and Justice and Personnel is serviced by the Rajya Sabha secretariat and headed by a Rajya Sabha member in this case Abhishek Manu Singhvi.Soon after the bill was referred to it, the Committee had invited team Hazare to place its views before the panel.Home Minister P Chidambaram had recently said that Hazare was free to place his views before the panel once again. Social Activist Anna Hazare is continuing his fast at Ramlila Ground in New Delhi to press for his demands, among other demands he is seeking inclusion of Prime Minister in the Lok Pal, Delhi Police has made elaborate security arrangements around the venue with about 400 personnel.

Hazare agreed to move from Tihar Prison, where he was kept after being arrested on 16th August to Ramlila ground in the walled city after government agreed to his demands of holding the fast without any restrictions on the number of supporters.

The 73-year-old Gandhian led a procession from Tihar prison and went to Rajghat to pay homage to Mahatma Gandhi before taking the centre-stage at the ground, a famous venue for the annual Dusherra celebrations.Team Ann member and a former top cop Kiran Bedi constantly addressed people telling them to maintain calm and remain peaceful as Hazare's procession inched towards the venue.Delhi Police has made elaborate security arrangements inside and outside the venue with about 400 personnel being deployed to ensure security of people. The Police set up several gates and frisked people before letting them in.Replying to questions whether he was shifting the goalpost after agreeing to restrict the fast to a fortnight, Hazare's close associate Arvind Kejriwal said "Anna Hazare will be here."

The Delhi Police Commissioner has agreed that the fast can be extended by a week on four days' notice, he said."We are willing to have a discussion with the government with an open mind but there cannot be any compromise on corruption," Hazare aid Prashant Bhushan said.

Jan Lokpal as pvt member's bill: Khurshid

Law and Justice Minister Salman Khurshid have made it clear that there was no restriction on any member wanting to bring Jan Lokpal Bill as a private member's bill in Parliament."Private members have no restriction at all. Private members can move any bill. When private members move a bill, then it is taken up as per rules and regulations of the House," Khurshid told reporters in New Delhi on Friday. The Law Minister was speaking in context of the proposed introduction of the Jan Lokpal Bill, backed by Anna Hazare and his team, in Parliament as a private member's bill.BJP Lok Sabha MP from Pilibhit Varun Gandhi has proposed to introduce the Jan Lokpal Bill as private member's bill. Varun said he intended to move the Bill next week.Khurshid said the private member's bill should have adequate support of members for it to be taken up and passed in Parliament."The Bill is considered in the House after adequate members support it. The House then passes the Bill or in normal course the minister gives an assurance by which the Bill gets withdrawn."The assurance is that their concerns will be factored into any further legislation that the government will bring. That's the standard procedure. If somebody is wanting to bring a private member's bill, then there's nobody stopping them. But they would have to get the necessary support of the members," said the Law Minister.Asked if a member bringing in such a bill wishes to have voting on it, Khurshid said, "If someone wants a voting, then they can have it."

Permission has been given to Anna Hazare and his associates for his fast at Ramlila Maidan till 2nd September and it is conditional, Home Secretary R K Singh said on Thursday.

He said the government was not involved in any discussion with Team Anna and it was the Delhi Police which held the talks and resolved the issue amicably.
"The Delhi Police discussed with Team Anna and, thereafter, they have come to a decision. What the Delhi Police conveyed to the Ministry of Home Affairs is that the permission was given till September two on the usual sort of conditions," he told reporters in New Delhi on Thursday.
Singh said it was not proper to say the agreement was a victory for one side and defeat for the other "but the basic issue was that permission for certain ground and certain period was given with some sort of conditions. If someone is saying that this is a victory or something, this is not the right way to say. This is not a question of victory or defeat," he said.
Home Secretary said conditions of a particular ground mandated a certain size of crowd as well as of available parking.
"An agreement has been reached on another ground and the size of that ground is much larger. So the size of the crowd does not matter," the Home Secretary said, referring to Ramlila Maidan.
