WHY WALMART FLIPKART DEAL REQUIRES AN INTERROGATION

WHY WALMART FLIPKART DEAL REQUIRES AN INTERROGATION
AMAZON & ALIBABA IN LINE TO FOLLOW THE PATH
PRAVEEN KHANDELWAL
Secretary General, Confederation of All India Traders
The Walmart-Flipkart Deal is under clouds of strong opposition from trading bodies and others as both are well known for flouting the policies, circumventing the law and indulging into deep discounting and predatory pricing. Being having the same mindset, they both agreed to enter into the deal with an urge to capture, control and monopolised not only e commerce market but even the offline retail trade of India. Interestingly, both e commerce and retail trade have no specific Government policy paving the easy way for both of them to manipulate things to their advantage. More than Flipkart, it is an opportunity for Walmart to fulfil its desire to enter the Indian market which it is trying desperately since years. For Flipkart, it is the best offer for making money and earning huge profit. The Venture capitalist and Private Equity people those who have funded Flipkart have all smiles since their part of share is earning them handsome margin. Only the poor retailer of the Country is at the receiving end.
Flipkart has a leading market share across certain product categories (like smartphones and fashion) through a combination of predation (which they have admitted in a tax proceedings), exclusive tie ups and preferential sellers. The market presence would be further augmented once the said transaction takes place. This would lead to adverse effect on both offline market and online markets. The offline retailers/ wholesalers would not be able to compete with the said conglomerate due to lack of funding and  due to the prevalent market practices, small traders have to partner with e-commerce players like Flipkart but they have to face discriminatory conditions. This fact would be accentuated since Flipkart would, probably, give preference to inventory of Walmart. Both Walmart and Flipkart have a demonstrated history of engaging in predation, which they would continue in India, resulting in foreclosure to other offline retailers/wholesalers.
Walmart,, would sell its inventory on the platform of flipkart.com either directly or through a web of associated preferred sellers with the result that their market share would rise exponentially and pure offline retailers / wholesalers would have two options: (i) exit the market or (ii) sell their goods on flipkart.com and face discriminatory terms and conditions fromflipkart.com in comparison to its preferred sellers. There is no level playing field on flipkart’s platform. There is a clear case of discrimination which is there between preferential sellers and other sellers in terms of commission, discounts etc. which would be further accentuated because of this transaction. There is a clear case of denial of market access for these non-preferential sellers on online platform coupled with complete annihilation of small time trader on offline platform.
Flipkart and Walmart have access to vast amounts of data, which they would use for targeted advertisements for consumers. They would create private labels (on the lines of Smart buy etc.) for products which are fast moving (based on data analytics) and sell the same via their preferred seller network. These preferred sellers, like WS Retail, Retailnet, Omnitech Retail, SupercomNet are only on the platform of Flipkart and not on any other platform. The present modus operandi is very clear: Flipkart purchases goods and sells at discounted prices, while incurring a loss, to few sellers like W.S. Retail, Retailnet, Omnitech Retail which are further sold on the platform of Flipkart. Flipkart purchases goods and sells at discounted prices, while incurring a loss, to few sellers like W.S. Retail, which are further sold on the its platform.
Furthermore, there are important competition concerns regarding Walmart’s role on Flipkart’s B2B platform. With Walmart, a global retail giant with its own range of multi-brand products, attempting to take another shot at the Indian market, there is a high likelihood of Flipkart and Walmart would affect other wholesalers on the platform and eliminating them in the long run. In several cases global search engines have been shown to use certain algorithms to favour their partners or services in searches and there is a possibility for Flipkart to increase listings for Walmart’s inventory or propagating a search bias for Walmart’ inventory in its platform. Similar to the entire modus operandi of preferential sellers, they may create preferential sellers with better commissions / discounts in order to augment the sale of Walmart’s inventory. This would have an adverse effect on competitors in both the online and offline market, both at the B2B level and B2C level. In addition, Flipkart (through its subsidiary, Myntra) has launched private labels which are Myntra Fashion Brands on which they are sold at high margins, and Flipkart also controls the sales, marketing and distribution of their products. The sellers of these private brands are also preferential sellers of Flipkart, thus eroding the very concept of level playing field.
The combined entity would have affiliates in the entire supply chain. The Complainant apprehends that the deal is bound to circumvent established laws and FDI policy of the government since the ultimate object of Walmart is to enter the retail trade of the country and in the absence of any policy on e-commerce or retail trade, it would be easy for Walmart to reach out to retail market, which otherwise it cannot enter due to FDI policy.Capital is huge entry barrier (due to the manner in which the said market has evolved) and even established players would find it difficult to enter this market unless they are fine with burning cash.

Solidarity of Delhi Medical Association with resident doctors of SGMH

F.75/DMA/2018                                                   30th May 2018
The Health Secretary
Govt. of NCT Delhi
New Delhi

Sub: Solidarity of Delhi Medical Association with resident doctors  of SGMH
Sir,
Delhi Medical Association is seriously concerned about frequent episodes of assault on doctors in various government and private hospitals. In the last few days, many medical establishments and doctors have witnessed violence and damage to their properties by the attendants of the patients.
DMA condemns the brutal attack on Resident doctors in Sanjay Gandhi Memorial Hospital on 28th May 2018. The medical fraternity is very much perturbed, outraged, appalled and anguished by increasing instances of attack on doctors and Authorities failing to provide security. Our main concern is the famothable degree of the ruthlessness of general population against doctors, vindictive and personal hatred for the fraternity and is propagating day by day.
Every doctor feels desolated in Delhi  over SGMH  issue even on 3rd day of peaceful protest, the government continues to derelict its responsibility of safeguarding interests of the medical fraternity. No efforts have been taken by authorities to encourage despondent fraternity, there is on the act of atonement from the government or the authorities which is disheartening.
The recent attack on the doctor in SGMH glaringly exposes lack of security in the hospital. Around 80 miscreants barged in the office of medical superintendent, well equipped with sharp knives and sticks and attacked doctors including senior residents and senior faculty gathered there for unbiased and fair analysis of the instance happened on 27th May in Paediatrics Emergency. The residents were beaten savagely and needed to be rescued.
On 27th May despite their best efforts doctors could not save a sick of 8 months old patient. Agitated attendants took doctors for hostage and could be rescued by intervention by police only. On 28th May, a committee was constituted and the members were attacked amid inquiry.
This reprobate behavior has left the whole fraternity and doctors in the state of shock and fear. Residents and President and President RDA  of SGMH are being threatened with dire consequences.
Doctors are deprived of every single basic need at workplace be it security of workplace, remunerations, job security or even our mental health. Despite putting most productive years of life in service of mankind and society and being denied our basic right, we are left with mere resentment observing such callous attitude towards us. Hard work done by the resident doctor is denounced by the public and they have to bear the wrath of anguished attendants on day to day basis.
While condemning the assault in strongest terms, Delhi Medical Association urges upon the government of Delhi to take immediate and strong action to apprehended the perpetrators of such heinous crime and ensure that expeditious justice is meted out to them as per law.
Delhi Medical Association will join the protest with SGMH by PEN DOWN and if demands are not met we will force to shut down the healthcare services in the state from 2nd June 2018
Thanking You,
Yours Sincerely,

Dr. Ashwani Goyal
President, DMA

PM Modi seen off by Dy PM Anwar

Prime Minister Narendra Modi was seen off at the Malaysian airport by former PM Anwar Ibrahim and his wife Wan Azizah, who is the current Deputy PM, before departing to Singapore,
Modi is the first foreign leader Anwar has met after being released from prison. He was jailed for sodomy three years ago.
Anwars release was the first big success of the newly elected governing coalition, Pakatan Harapan, led by 92-year-old Mahathir Mohamad, which was swept into power after a shock election victory.
Few in Malaysia have been persecuted for their political views and popularity like Anwar, a man with three prison sentences and 11 years in jail to his name. The pardon was filed on the basis of a miscarriage of justice, thus clearing his name entirely.
It was his first taste of freedom since 2015, following a prison sentence widely perceived as politically motivated; a manoeuvre by former prime minister Najib Razak to get rid of a feared political rival who had run against him and won the popular vote in the 2013 general election.

JD-S get finance portfolio, Cong gets Home in Karnataka:

Janata Dal-Secular-Congress coalition in Karnataka has solved the cabinet tussle.
The JD-S will get the finance ministry, while the Congress will get to keep the home ministry.
Apart from the home ministry, the Congress would get heavy industries, energy, IT/BT, travel and education portfolios. While JD-S will hold revenue and co-operative affairs ministries.
The Congress and JD-S formed a post-poll alliance on May 15 after the BJP had staked claim of forming the government. But the move turned out to be a major embarrassment for BS Yeddyurappa, who had to quit as chief minister within days of staking claim.
HD Kumaraswamy was then sworn in as the Karnataka chief minister and G Paramewshara took over as his deputy.

Will Mahathir Mohamad cancel high-speed rail project?

https_%2F%2Fs3-ap-northeast-1.amazonaws.com%2Fpsh-ex-ftnikkei-3937bb4%2Fimages%2F0%2F4%2F0%2F7%2F14027040-4-eng-GB%2F0529N11-Shinkansen.jpg
With the change in Malaysian government there is an important bullet train project to be implemented with the collaboration of Japanese firms in spite of media rating this project to be shelved by the statement of PM Mahathir Mohamad but this project is an important project in coordination with the economy of south Asian countries which is free from encumbrances of China economy in influence trajectory with its economic growth, so this project between Singapore, Malaysia and Japan needs tripartite ponder again and the project shall take off in its wisdom as per the research team of Sagar media inc headed by Naresh Kumar Sagar.
Malaysia’s newly elected Prime Minister Mahathir Mohamad said Monday he would cancel the undertaking approved by his predecessor, Najib Razak, the decision to  a planned high-speed rail link from Kuala Lumpur to Singapore. This scrap means  blindsided Japanese contractors looking to cash in on the $14.8 billion project.
The project was supposed to be completed by 2026 and make the 350km train trip in 90 minutes.
Bidders from Japan, China and Western nations were looking to land contracts that were to be awarded by the end of this year. A Japanese consortium including East Japan Railway and Sumitomo Corp. was hoping to export Japan’s acclaimed shinkansen technology.
“The consortium has not been able to make official contact with Malaysian authorities, so the true intentions are not known,” said a source close to the Japanese partnership.
Shinkansen technology is employed in Taiwan, and it will feature in the 500km high-speed line to open in India in 2023. But Japan’s high-speed rail industry is competing with CRRC, the world’s largest manufacturer of rolling stock leveraging low costs in a crowded market. The Asia-Pacific rail market averaged 58.9 billion euros ($67.9 billion) between 2019 and 2021, according to Japan’s Ministry of Economy, Trade and Industry.
Moreover, high-speed rail projects often face challenges and have failed in the past in other countries, said a person close to a rolling stock manufacturer. Projects in Mexico, Venezuela and Brazil come to mind.
“Because of the prevailing risks, I would proceed cautiously,” said the source close to the Japanese consortium.

Nominated books must have been published after August 2016 and must still be in print. Publishing houses from any country may submit titles for consideration. The deadline for submissions is 8 June 2018. The jury will select a shortlist of five titles which will be announced at the end of August.
The prize is part of the Frankfurter Buchmesse Film Awards which will be given in three categories for the first time. UNSGSA, visits Meerut

 29 May 2018
UN Secretary-General’s Special Advocate for Inclusive Finance for Development (UNSGSA) visits Meerut
Queen Maxima of Netherlands, in her capacity as the UN Secretary-General’s Special Advocate for Inclusive Finance for Development (UNSGSA) was in Meerut to visit the customers of Aye Finance, a leading fintech lender to the micro and small entrepreneurs in India.
MSME financing has always been a key priority for the Queen and the purpose of her visit was to understand how Aye Finance was bringing this critical sector of our economy in to the inclusive folds of organized lending by providing an affordable line of credit.
Her Majesty has been a Special Advocate for Inclusive Finance for Development since 2009 and since then she has been a global voice advancing universal access to affordable, effective, and safe financial services. Aye Finance was founded in 2014 with a commitment to provide innovative and customer-centric financial services to micro and small businesses and power their growth into the new-age India, and since then it has enabled the inclusion of 60,000 such enterprises into the mainstream of the economy.
Tuesday morning Her Majesty travelled from Delhi to Meerut to meet Aye’s customers, who belong to the sports manufacturing cluster of the city. Aye’s founders, Mr. Sanjay Sharma and Mr. Vikram Jetley briefed her on their unique “Cluster Based Credit Assessment” methodology to underwrite the risk of lending to these bottom of the pyramid businesses. These businesses have been traditionally ignored by the Banks and financial institutions as they do not maintain formal books of accounts and seldom have credit histories making the assessment of their credit worthiness a challenge and there by stunting their growth. Aye Finance has innovated on deriving lending insights from alternate data from its markets and deploys low cost mobility and cloud based technologies to reach out to these thriving albeit underserved micro businesses.
Over the past few years, Her Majesty has emphasized on the potential of mobile and digital technology as a strong enabler for financial inclusion. Aye showcased its customer mobile app “mAye” which is helping its customers run their business more efficiently by recording business data in a structured manner and gaining insights on their businesses.
Queen Maxima interacted with three of Aye’s customers who manufacture cricket equipment. They advised her about their aspirations and how Aye has helped by providing adequate finance to grow their businesses. She interacted with their women workers also and was happy to see them being equal partners in these businesses.
The 50 million micro enterprises in India have the potential to uplift the Indian Economy and bring a positive social dividend across a large segment of its population. Inclusion of these enterprises in the formal economy is a governmental priority and is expected to help the Country transition to an economic powerhouse.

Police Complaint Authority

LG of Delhi :Police Complaint Authority – Not Enough for Criminal Minded Police
May28, 2018 (C) Ravinder Singh progressindia2015@gmail.com
Honorable Lt. Governor,
Shri Anil Baijal,
NCT Of Delhi.

CC to Commissioner of Police, DP
Police Complaint Authority – Not Enough for Criminal Minded Police
ü PCA to Have Supervisory & Advisory Role Than A Trial Court.

Respected Sir,
What is Solely Missing in our LEGAL SYSTEM is that though India has Both Criminal & Civil Branches of Judiciary – but for some strange reason ‘Criminal Cases Are Registered As Civil Cases and Civil Cases are Registered as Criminal Cases’ WHEN BOTH CIVIL & CRIMINAL ACTS ARE PRESENT IN EACH CASE – LIKE FORGERY OF DOCUMENTS, CHEATING IN CIVIL MATTERS. Whereas in matters of OJ Simpson of USA or Oscar Pistorius of SA were tried for both Civil & Criminal Liabilities.
In Supreme Court SLP(C) 28441 of 2008 – A Poor Farmer and A Businessman entered in to ‘EXCHANGE DEED’ – while Businessman got 2.5 Acres of Land of Farmer in Gurdaspur village transferred in his name but the Farmer when wanted 5 Acres of Land in Exchange in Uttarakhand to be Transferred in his name – found the Documents to be Fake or Forged.
Purely a CHEATING CASE was Tried in CIVIL COURTS FOR 12 YEARS from Tehsil to District to High Court and Supreme Court. There were 50 FIGHTS & Police Cases at the time of Sowing & Harvesting and Construction Activity – Police didn’t register it asCHEATING CASE in 12 Years which was a Cheating Case from day one.
A Police Officer was simply required to ‘Register an FIR Against Businessman’ to Resolve the matter Peacefully at No Cost to Victim.
When I was responsible for SECURITY of CPWD’s largest store serving 50% of India in 1976 – a JE of Rashtrapati Bhawan whispered – ‘All The Lamps Procured Last Month Had Fused’ – in less a second I added three more words ‘Please Issue GOOD QUALITY LAMPS’which were all Certified to be of Good Quality by ISI and DGS&D. No Substandard Goods were allowed in CPWD stores thereafter for many years even after I left.
PCA – LAMEDUCK AUTHORITY – LIMITED POWERS
NO ADVISORY OR SUPERVISORY ROLE.
Sir it is Great Idea to Have ‘Police Complaint Authority’ led by retiredHigh Court Judge, Retired IAS and Retired IPS and some Prominent Citizen but –
Their Powers Are Limited to Admit ‘Criminal Acts of Police Force of Delhi’ But Not Cases Where Delhi Police GUIDE & HELP CRIMINALS and Seems to EXCLUDE –
ü Millions of Cases Where Delhi Police ‘Help Criminals Of All Kinds Including Serial or Habitual Criminals from Pick-Pockets to Land Mafia By Letting Them Go Free By Not Registering FIRs or Lame Duck FIR for Bribes.’
ü Delhi Police is JERSEY Cow for Criminals – Victims get Dung.
REMEDY –
ü PCA Should Work As A ‘Supervisory & Advisory’ Institution than Trial Court with Simple Complaint Filing Procedure, Forward Cases to Independent Investigating Agency like CBI.
ü Provide for DISTRICT POLICE COMPLAINT AUTHORITY attached to Each District Police Office.
ü IPS Officers to Monitor 100 Help Line Complaints and Meet Victims from 10AM to 5PM every day.

#DignityInDeath
