Gauhati HC order that declared CBI illegal is invalid: SC

9112013

Supreme Court today stayed the Gauhati High Court’s  order declaring the Central Bureau of Investigation or CBI as “unconstitutional” which didn’t have the power to investigate crimes. The top court has fixed December 6 as the next date for hearing in the matter.

There shall be a stay of operation of impugned judgement of Nov 6, 2013 passed by Gauhati High Court,” said a bench of Chief Justice P Sathasivam and Justice Ranjana Desai at an urgent hearing held at the former’s residence this afternoon.

Federal Government moved the top court today, seeking an immediate stay on last week’s High Court order which it called “erroneous”, arguing that the verdict would adversely impact thousands of criminal cases pending across the country.

Gauhati High Court had, on Wednesday, said that the CBI could not be treated as a police force; it could only conduct “inquiries”. This meant the government’s premier investigating agency stood to lose its power to probe, file FIRs or First Information Reports, arrest suspects and file charge-sheets.High Court order was based on the premise that the Union Home Ministry’s order, under which the CBI was set up in 1963, was invalid as police investigations are under a state’s purview. The court said the Centre had failed to prove that the CBI had been constituted as a special police force under the Delhi Special Police Establishment Act of 1946, from which it derives its powers to investigate. The Centre’s resolution, it noted, was not even sent to the President and never received his assent.

The Federal government should take steps to give the CBI a ‘constitutional shape’ in the wake of the Gauhati high court order, as it has serious implications for the “very important agency,” Jammu and Kashmir Chief Minister Omar Abdullah said.

“The government should think very seriously what steps are needed to be taken to give proper structure and constitutional shape to CBI,” Omar told reporters.

An event at The Asia Society

9112013
Reimagining India
An event at The Asia Society
WHEN: Tuesday, November 19, 2013, 6:30-8PM (Program preceded by a reception at 5:30pm.)
WHERE: The Asia Society - 725 Park Avenue, New York, NYIndia is “rising” and “shining” — but is it doing so as quickly or as brightly as it should? There is mounting frustration, in India and overseas, that the burst of economic liberalization of the 1990s and the rapid growth in the first decade of this century have given way to deadlock and complacency. But over the next decade, India has an opportunity to show the rest of the developing world how open, democratic societies can achieve growth and prosperity. What is India’s true potential? And what can be done to unlock it?
McKinsey’s Reimagining India: Unlocking the Potential of Asia’s Next Superpower, is a seminal new book with an all-star cast of contributors, including CNN’s Fareed Zakaria, Mukesh Ambani, Bill Gates, Eric Schmidt, Muhtar Kent, former Asia Society president Vishakha N. Desai, and others. The book and this panel event will offer an inside-out and outside-in perspective on how an alternative emerging market economic model like India’s — a culturally and geographically complex, and politically colorful society — can achieve high growth, economic stability, shared prosperity, and environmental sustainability.
Join Asia Society and McKinsey as we discuss India’s future with a selection of the book’s contributors. Shop at AsiaStore for the book!
Speakers:
Christopher Graves is the Global Chief Executive Officer of Ogilvy Public Relations Worldwide. He has been a contributing author for McKinsey books including Reimagining Japan, and is a life member of the Council on Foreign Relations. He has been a speaker at major events such as the World Economic Forum, Clinton Global Initiative and Bo’ao.
Suketu Mehta is the author of Maximum City: Bombay Lost and Found. An Associate Professor of Journalism at New York University, he is a recipient of a Guggenheim fellowship, the O. Henry Prize, and several other awards. He was raised in Bombay and New York.
Arvind Subramanian is the Dennis Weatherstone Senior Fellow at the Peterson Institute for International Economics and Senior Fellow at the Center for Global Development, Washington D.C. In 2011, Foreign Policy magazine named him one of the world’s top 100 global thinkers.
Adil Zainulbhai is the chairman of McKinsey India. In his 33 years at the company he has advised leading CEOs and government agencies, and focused on helping Indian companies meet their growth aspirations and become successful globally.
Edward Luce is the Washington Bureau Chief of the Financial Times. He formerly served as the Lead Economist for South Asia at the World Bank, and is the author of In Spite of the Gods: The Strange Rise of Modern India.

Pension Parishad, to hold a demonstration

9112013
Pension Parishad, to hold a demonstration of elderly people and other marginalised groups during every session of Parliament until our demands are at least substantially met. While the nature of the demonstration has differed depending on the situation, we have complied with and followed this decision in every Parliament session since the pension Parishad was formed in February 2012.

We are writing to you today to invite to join us in another protest during the winter session of parliament. About 500 elderly people from across the country will sit through in Delhi from 25th November, 2013 till our demands are substantially met.

During the budget session, on March 6, 2013 over 15000 elderly persons from 26 states assembled at Parliament Street to demand specific assurances from the government. The Minister for Rural Development, ShriJairam Ramesh first worked out an “in principle” agreement with the Pension Parishad based on Instructions from the Prime Minister. (copy attached) The Minister then came to Parliament Street and addressed the gathering, where he made a similar statement.
While the Governments assurance is yet to be realised, there are many States where there has been progress in moving towards the Pension Parishad demands for Universal Pensions. Needless to say this is not enough, but it has energised the elderly tremendously. It is clear that as crucial state and central elections approach, if we seize the moment and organise the elderly, they stand to benefit a great deal in moving towards living a life of dignity.

We had a one day dharna on Thursday the 22nd of August. We also decided to plan and fix the next course of action in the struggle. The Delhi groups decided to carry out a detailed house to house survey in select localities to understand the nature, reach, and effectiveness of Delhis pension schemes. A brief report of this study is now ready.

The winter session of parliament is possibly the last opportunity that we are likely to get to push for universal pensions before the elections are announced.

Assembly elections have been scheduled in five states, one of which is Delhi. Groups from across the country have been suggesting that 25th November onwards would be a good time for Pension Parishad to mobilise around the pension issue. The idea is to push for ‘manglekar aye hain, pension lekarjayenge’. We have an initial plan to “sit” for at least a month till a substantial proportion of the demands are met. During this period other people’s movements and campaigns would also participate so that many issues are articulated at the dharna during this period and feed into a peoples manifesto document that could be used during the national elections.

The presence of about 500 elderly people daily in the cold Delhi winter will be a challenge for us, but also a pressure on parliamentarians. Any volunteers for doing preparatory work prior to and after the dharna would be enthusiastically welcomed! So would support that can be extended in any form.

Please do forward this invitation to all networks you may be linked with and who will extend their support to this cause. Please do reply immediately, contact us on… and let us know how many people will come to Delhi on the 25th of November, 2013.

With apologies for any cross-posting.

Coca-Cola Cricket CupⳠVision

BCCI over the past several years has done a tremendous job of enhancing the growth of cricket in India. They have done so by adopting a result oriented approach of organising age group tournaments all over the country through their state associations.

This has helped immensely in carving out talented individuals on a regular basis. Most of these cricketers have moved ahead and have brought laurels for their states and the country.

Seeing the vast potential and growing popularity of this game, Coca-Cola India has a vision of facilitating BCCI in their quest to tap talent. We believe that the future of Indian cricket lies in these young talented budding cricketers. We intend to provide a perfect opportunity and platform to all the youngsters across the country to showcase their talent, skill and equally important, pride and loyalty to their school. It gives BCCI and their affiliated state units a brilliant arena to scout for potential match winners.

We hope that this initiative will serve as an ideal platform to identify and nurture young talented cricketers for them to be able to get noticed by the state associations and BCCI to represent the country on an International level.

HUNGARIAN LANDSCAPES – HUNGARIAN PLACES
Graphics by János Bozsó
The exhibition presents graphics from artist and avid art collector János Bozsó. Even for those who know János Bozsó’s art well his graphics have an astonishing effect. On the artist’s graphical sheets the figural depiction appears frequently. All of his work – pencil drawings, pastels, aquarelles – tell a story about the people and the Hungarian landscape because he was devoted to them. His creative method drew character of virtuosity and rapidness however his technical knowledge never overcame the message of his work.
